Trade
mark legislation in Ethiopia:
Ethiopia
has prepared a new trade mark legislation by which the trade mark
owner would no longer require to file a legalized copy of a corresponding
trade mark registration, from the Ethiopian Intellectual Property
Office (EIPO) as was necessary under the previous system.
Instead, any trade mark which is represented graphically and consists
of a letter, word, numeral, design or a three-dimensional shape
may be registered, provided that it is distinctive. Companies
launching a new trade mark filing programme will not need to wait
for registration in another jurisdiction before filing in Ethiopia.
The current period for registration will be for a 10 year term of
protection instead of past 6 years period.
The new
law also contains provisions for action by the owner against the
infringement of the trade mark and will enable customs, to seize
and retain under its control goods, which in its opinion, constitute
infringed goods.
Once the
new legislation is promulgated, it will bring Ethiopia's trade mark
law into line with other jurisdictions.
