Importation of counterfeit goods- Argentina
On February 26, 2007, Argentina's Customs authority issued a Resolution creating a Warning Registery in which trademark and copyright owners can voluntarily register their ownership interests in IP rights, enabling Customs to efficiently combat the importation of counterfeit goods and the piracy of IP rights. Although registration is not mandatory but it is recommended for those dowing trades with Argentina. The registration is valid for two years and is renewable.
Under the Resolution, all importations that declare a registered IP right in the bill of lading, apart from importations by the legitimate right holder, will be stopped at the border by Customs for three days and will be notified within that period to the IP owner or its local representative or empowered agents about the potential importation which on request may be verified by the customs agents in the presence of the right holder or its authorized representative to determine the goods' authenticity. If an infringement or fraud is found, both Customs and the right holder will be free to initiate the administrative or judicial action.
The Customs registration must include: (a)information about the IP rights holder, (b) a copy of the trademark or copyright certificate of the appropriate authority, (c)detailed characteristics of the authentic merchandise protected by the cited IP rights, (d) merchandise identification codes, and (e) Customs Office through which the protected merchandise usually arrives in Argentina, if applicable.
The Registry will be effective from April 3, 2007.
