Registration of Domain Name“.it” in Italy
Registration of a domain name in Italy is not complex, but unlike other extensions, one cannot file an application for an ‘.it’ domain name solely online. There are some restrictions that include (a) domain names must comprise a maximum of 63 characters of the Latin alphabet, numerals and hyphens and (b) applicants must have registered place of business within the European Union. The NIC.it organization which is a resistering authority processes the applications for registration of a domain name. The IP Code in Italy has clarified that domain names are not merely addresses, but valuable properties which should not be confusingly similar to a previously registered trademark Therefore, the domain name should be either owned by a registrant which clearly exhibits commercial purposes or used for selling goods or rendering services with a certain monetary value.
Another procedure introduced was mandatory procedure (called opposition) under which a complainant should file a complaint regarding a specific domain name and its grounds for the dispute with the organization NIC.it which will block the transfer of the disputed domain name for 3 months, if the complainant is residing or his place of business is within the European Union.
Court proceedings will prevent the domain name from being automatically transferred to the complainant. However, stopping a dispute through a court case is a strategy which the most cybersquatters frequently use. In such a case, the complainant may request the court that the domain name be cancelled rather than transferred to itself, but since chances are that the same or another infringer will try to register the domain name, requests for cancellation are rare.
