Establishment of New IP Court in Japan
In the recent developments which has taken place in Japan, one of the developments is setting up of a new IP High Court to deal exclusively with patent and computer infringement cases. These cases were earlier dealt by Tokyo High Court including the other cases. However, with the reorganisation of Tokyo High Court by establishing New IP High Court on the lines of US Court of Appeals for the Federal Circuit (CAFC), it has substantially succeeded its position and strengthen the intellectual property system in order to promote and stimulate Japan's economy just like the US Pro-patent Strategy. Since the setting up of IP High Court, cases relating to patent infringement have dramatically decreased. The industry circle has observed that some of the decisions in the area of patent infringement and cybersquatting, the new court has made control over pro-patent developments in Japan rather than improving or promoting Japan nationwide pro-patent strategy like US CAFC which has become successful.
