Development of IP Law - Syria

 

 

A new Intellectual Property Law has been enacted on April 12, 2007 to include distinctive marks, geographical indications and industrial designs and models by the Syrian People's Assembly. According to the law, a trademark will be registered if it is distinctive as to words, letters, numbers, figures, colors or other signs that are visually perceptible. The law provides protection for collective, certification and service marks, and recognizes well-known international trademarks even if they are registered in Syria. Additionally, the new law provides for a separate application for each class; in the case of renewals of existing registrations, a separate application must be filed for each class.

The law introduces (a) a trademark opposition system where any third party can oppose the trademark application within a period of 90 days from its publication; (b) incorporates setting up a specialized court and improved customs measures to settle IP cases and the regulation of IP agents in Syria; (c) trademark validity and protection for 10 years renewable for similar consecutive periods, non-use of marks for three cotinouous period may lead to cancellation by any registered person; (d) guarantee that the rights of trademark owners are well protected, penalties for trademark infringements increased and violators penalized with imprisonment or fine.

A new scale of official fees for the registration and maintenance of trademarks and industrial designs have been introduced in the law wherein Fees have substantially been increased and in many instances have been doubled.
