Trademark Infringement - US
Cisco had filed suit against Apple in the US District Court for the Northern District of California on January 10, 2007, on the announcement of Apple for launching of a new mobile telephone and multimedia device to be sold under the iPHONE trademark. In the lawsuit, Cisco alleged its rights in the IPHONE trademark dating back to 1977, pursuant to a trademark registration for the mark that it acquired from InfoGear Technology Corporation. Furter it alleged that Apple had first approached Cisco in 2001 about licensing the rights to IPHONE and continued to make such requests through the present. Accordingly, Cisco accused Apple of, among other things, trademark infringement and unfair competition. However, after the out of court settlements on February 21, 2007, in their joint press release both the companies announced that they had settled their dispute to use the iPHONE mark worldwide. Further, each company acknowledged existing ownership rights in the trademark and agreed to dismiss any pending actions concerning the issue. Finally, the two companies agreed to explore opportunities to collaborate on future projects in the areas of security and of consumer and enterprise communications. The remaining terms of agreement have not been disclosed for the sake of confidentiality.
